Die Fraunhofer-Gesellschaft (weiter: Auftraggeber) beabsichtigt, externe Rechtsdienstleis-tungen zur Unterstützung der internen Rechtsberatung zu beschaffen, wobei im Rahmen der Erbringung der Rechtsdienstleistungen zu berücksichtigen ist, dass die Fraunhofer-Gesellschaft als eine nach Art. 91b GG von Bund und Ländern geförderte gemeinnützige außeruniversitäre Forschungseinrichtung in der Rechtsform eines eingetragenen Vereins öffentlich-rechtlichen Rahmenbedingungen unterliegt, die in sämtliche Beratungsbereiche hineinspielen können. Hierzu soll ein Rahmenvertrag über anwaltliche Beratungs- und Un-terstützungsleistungen im Bereich Biotechnologie/ Gentechnikrecht abgeschlossen werden: Vorgesehen sind die Beratung und Unterstützung des Auftraggebers bei rechtlichen Frage-stellungen im Biotechnologiebereich, einschließlich, aber nicht abschließend, Gentechnik-recht, insbesondere im Zusammenhang mit F&E-Verträgen und Lizenzverträgen. Die Leistungen gem. § 116 GWB sind nicht Gegenstand der vorliegenden Beschaffung.
