    Der/die Auftragnehmer/-nachfolgend AN) fungiert als treuhänderisch tätiges und beliehenes Unternehmen für die für Arbeit zuständige Senatsverwaltung (Auftraggeber/Auftraggeberin, nachfolgend AG) und gewährleistet die Umsetzung der in den Förderanlagen zum Vertrag beschriebenen Instrumenten sowie solchen, die diese ersetzen oder diesen nachfolgen (s. § 1 Nr. 1.2 dieses Vertrages). Der/die Auftragnehmer/-in ist dort als Bewilligungsstelle bezeichnet, die/der AG als fachaufsichtführende Senatsverwaltung. Für die Bewilligung, Auszahlung und Abrechnung der Zuwendung sowie für den Nachweis und die Prüfung der Verwendung und die ggf. erforderliche Aufhebung des Zuwendungsbescheides und die Rückforderung der gewährten Zuwendung gelten die Ausführungsvorschriften zu § 44 LHO sowie §§ 48 bis 49a Verwaltungsverfahrensgesetz (VwVfG), soweit nicht in den Förderanlagen Abweichungen zugelassen worden sind.
