Overview
The McCloud Judgement refers to a ruling by the Court of Appeal, which instructs that remedies are put in place to remove age discrimination from public sector pension schemes following the 2015 reforms. As providers of the NHS Pension Scheme, DHSC and NHSBSA are within scope of this judgement and must therefore comply with legal obligations. In addition to this, the recent announcements around NHSE and ICBs will lead to an unforeseen significant spike in Pension workloads with an expectation that these members are prioritised and timescales aligned with DHSC expectations and timelines. Work will include redundancy estimate requests, end to end retirement calculations and then putting pensions into payment. The calculations required for impacted McCloud members will add complexity as Pensions Savings Statement will also need to be produced. Resource required for this work are highly skilled Subject Matter Experts.
