Hankinnan kohteena olevat terät ovat laitesidonnaisia Varsinais-Suomen hyvinvointialueen omistamiin Stryker ab Finland korkeakierrosporiin. Kyseisiä poria käytetään neurokirurgisissa leikkauksissa. Laitevalmistaja on ilmoittanut, että korkeakierrosporissa voidaan käyttää ainoastaan heidän valmistamiaan teriä. Korkeakierrosporien kanssa käytettävien terien ainoa mahdollinen toimittaja on Stryker ab Finland. Suorahankinnan perusteena on hankintalain 40 §:n 2 momentin 2 kohta teknisestä tai yksinoikeuden suojaamiseen liittyvästä syystä vain tietty toimittaja voi toteuttaa hankinnan; lisäedellytyksenä on, että järkeviä vaihtoehtoisia tai korvaavia ratkaisuja ei ole eikä kilpailun puuttuminen johdu hankinnan ehtojen keinotekoisesta kaventamisesta.
