Dostawa dwóch mieszalników akustycznych”/ "Supply of two acoustic mixers

1. Przedmiotem niniejszej Umowy jest dostawa do Sieć Badawcza Łukasiewicz - Instytutu Przemysłu Organicznego dwóch mieszalników akustycznych wraz z ich instalacją oraz przeszkolenie personelu Zamawiającego. / The subject matter of this Agreement is the supply of two acoustic mixers to the Łukasiewicz Research Network - Institute of Industrial Organic Chemistry, their installation and training for the Ordering Party's staff. 2. Szczegółowy opis przedmiotu zamówienia został zawarty w załączniku nr 1 (OPZ). / The detailed description of the object of the order is given in Attachment 1 (Description of the object of the order). 3. Opis przedmiotu zamówienia w oparciu o Wspólny Słownik Zamówień (CPV): / Description of the subject matter of the contract based on the Common Procurement Vocabulary (CPV): 43412000-4 Mieszalniki / 43412000-4 Mixers 4. Miejsce realizacji zamówienia: Sieć Badawcza Łukasiewicz - Instytutu Przemysłu Organicznego, ul. Annopol 6, 03-236 Warszawa. / Place of performance: Łukasiewicz Research Network - Institute of Industrial Organic Chemistry, ul. Annopol 6, 03-236 Warszawa. 5. Zamawiający nie dokonuje podziału zamówienia na części i tym samym, nie dopuszcza składania ofert częściowych. Uzasadnienie: Mieszalnik akustyczny jest innowacyjnym rozwiązaniem technologicznym o ograniczonej dostępności rynkowej. Uzyskanie zestawu mieszalnika wraz z dedykowanym oprzyrządowaniem pomocniczym, może stanowić o dalszej skuteczności inwestycji. Celem zamówienia jest zapewnienie kompleksowego zestawu dedykowanego do formowania stałych paliw rakietowych. Dodatkowo, brak podziału zamówienia na części ogranicza ryzyko niezgodności technologicznej pomiędzy poszczególnymi elementami systemu oraz upraszcza proces wdrożenia - od dostawy, przez instalację, aż po uruchomienie i przeszkolenie personelu. Eliminuje również konieczność koordynowania działań różnych wykonawców, co wiązałoby się z dodatkowymi nadmiernymi kosztami oraz trudnościami organizacyjnymi, a w konsekwencji mogłoby zagrozić terminowej i prawidłowej realizacji zamówienia. Ze względu na zasadę racjonalnego wydatkowania środków przez Zamawiającego, niecelowy jest podział zamówienia na części. / The Ordering Party does not divide the contract into parts and, therefore, it does not allow partial bids. Justification: An acoustic mixer is a technological innovation with limited market availability. If a mixer set along with dedicated ancillary instrumentation is obtained, this can affect the further effectiveness of the investment. The purpose of the contract is to provide a comprehensive set dedicated to the formation of solid rocket propellants. In addition, the fact that the contract is not divided into parts reduces the risk of technological incompatibility between individual system components and simplifies the implementation process - from supply, through installation to commissioning and staff training. It also eliminates the need to coordinate the activities of various contractors, which would entail additional excessive costs and organisational difficulties, and in consequence could jeopardise the timely and proper performance of the contract. Due to the principle of reasonable spending of funds by the Ordering Party, it is not appropriate to divide the contract into parts. 6. Zamawiający nie zastrzega obowiązku osobistego wykonania przez Wykonawcę kluczowych zadań. / The Ordering Party does not stipulate the obligation of the Contractor to perform key tasks personally. 7. Zamawiający nie dopuszcza możliwości składania ofert wariantowych. / The Ordering Party does not allow for variant bids. 8. Zamawiający nie przewiduje zawarcia umowy ramowej. / The conclusion of a framework contract is not contemplated by the Ordering Party. 9. Zamawiający nie przewiduje wyboru oferty z zastosowaniem aukcji elektronicznej. / The application of an electronic auction is not contemplated by the Ordering Party. 10. Zamawiający nie przewiduje zwrotu kosztów udziału w postępowaniu z zastrzeżeniem art. 261 uPzp. / The reimbursement of costs of participation in the procedure is not contemplated by the Ordering Party, subject to Article 261 of the Public Procurement Law. 11. Zamawiający nie przewiduje wymagań, o których mowa w art. 96 ust. 1 uPzp. / The Ordering Party does not provide for the requirements referred to in Article 96(1) of the Public Procurement Law. 12. Zamawiający nie dopuszcza złożenia ofert w postaci katalogów elektronicznych lub dołączenia katalogów elektronicznych do oferty. / The Ordering Party does not accept the submission of bids in the form of electronic catalogues or the inclusion of electronic catalogues in the bid. 13. Zamawiający nie przewiduje możliwości udzielenia zamówień, o których mowa w art. 214 ust. 1 pkt 8 uPzp. / The Ordering Party does not foresee the possibility of awarding contracts referred to in Article 214(1)(8) of the Public Procurement Law. 14. Zamawiający wymaga realizacji przedmiotu zamówienia w terminie 4 miesięcy od dnia zawarcia umowy. / The Ordering Party requires that the object of the order should be performed within 4 months from the date of conclusion of the Agreement.
